Terms of Service

These Terms of Service (“Terms”) govern your use of the mental health services provided by Horizon Mental Health Services LLC (“Horizon”, “we”, “us”, or “our”). Please read these Terms carefully before using our services. By using our services, you agree to be bound by these Terms. Please refer to our Privacy Policy to learn how we collect, use, share, and protect your information.

Please do NOT use our services for emergency or urgent mental health matters. For all urgent or emergency situations, you must immediately call 911 or go to the nearest emergency room or urgent care facility.

1. Updates to the Terms

We may modify these Terms from time to time. We will notify you of material changes by posting the amended terms on the Horizon website at least thirty (30) days before the effective date of the changes. If we have your email on file, we will also notify you of material changes by email at least thirty (30) days before the effective date of the changes. Please ensure we have your current email address so that you will receive notice of any material changes. If you do not agree with the proposed changes, you should discontinue your use of the services before the effective date of the change. Continuing to use our services after the effective date means you accept the updated Terms.

2. Financial Responsibility; Assignment of Benefits

You agree to pay Horizon all applicable charges for the services provided to you. You authorize Horizon to charge your chosen payment method (“Payment Method”) for the services. If your Payment Method is invalid at the time payment is due, you agree to pay all amounts due upon demand. Horizon may accumulate charges and submit them as aggregate charges during or at the end of each billing cycle. We reserve the right to correct any billing errors even if payment has already been requested or received. We are currently out of network with all health insurance plans and do not submit claims on your behalf.

3. Appointments: Missed/Late Cancellation

  • Cancellations should be made more than 48 hours before the appointment time.

  • Missed appointments or no-shows will be billed 100% of the session cost.

4. Permission to Treat

You give permission to our Providers to provide medical care. You may withdraw this consent at any time by no longer seeking services from Horizon. As part of providing services, your Protected Health Information (as defined by HIPAA), including test results, may be released to an online personal health record and communicated electronically with Horizon’s healthcare team, in accordance with our Privacy Policy.

5. Service Termination

You may terminate your use of our services at any time by ceasing to use them. We may terminate your access to our services at any time in our reasonable discretion for causes including but not limited to illegal conduct, abusive behavior, or refusal to pay for services. We may terminate your access by sending notice to you at the address you provided.

6. Mental Health Services Disclaimer

Mental health services may involve discussing sensitive aspects of your life, and you may experience uncomfortable feelings such as sadness or frustration. If you experience significant distress or have thoughts of harming yourself or others, you agree to notify your mental health provider to receive appropriate support. Your provider may use psychological symptom questionnaires to assist with diagnosis and track progress.

7. Consent to Electronic Communications

You consent to receiving communications from Horizon via email, secure messaging, phone, text, or mail regarding our services, including legal disclosures and updates to these Terms. You agree to update your contact information to ensure accuracy. If you wish to withdraw consent for certain communications, you may do so by following the instructions in the communications or contacting us directly.

8. Disclaimers

To the maximum extent permitted by law, except in cases of negligence or willful misconduct, we and our affiliates, providers, employees, officers, directors, or agents will not be responsible for any loss or damage, including personal injury or death, resulting from the use or inability to use our services.

Our services are intended for use within the states we serve. We make no representation that our services are available or appropriate outside of these states. Accessing and using our services from outside our service states is at your own risk and responsibility.

9. Limitation of Liability

To the maximum extent permitted by law, in no event will we or our affiliates, providers, employees, officers, directors, or agents be liable for any consequential, exemplary, incidental, special, or punitive damages, including lost profits or the cost of substitute products or services arising out of or in connection with our services, whether based on contract, warranty, product liability, tort, or other legal theory, even if we have been informed of the possibility of such damages.

10. Telehealth Services and Permission

Horizon provides Telehealth services, which include virtual encounters via phone, video, or other electronic means. You consent to the use of automated tools for diagnosis and treatment. You acknowledge that virtual encounters may involve various providers and may require additional in-person care if necessary. You may withdraw consent for Telehealth services at any time.

11. General Provisions

These Terms constitute the entire agreement regarding your use of our services and supersede all prior agreements. We may change, suspend, or discontinue our services or partnerships at any time. These Terms do not confer any third-party beneficiary rights. You may not transfer your rights or obligations without our consent. Even after termination, these Terms will remain in effect as necessary.
